1. General Terms
By accessing and using the Provenance platform, you agree to be bound by these Terms and Conditions. Provenance operates as an online auction marketplace connecting buyers and sellers of curated collectibles, art, jewelry, and other special objects.
2. User Accounts
You must create an account to bid, sell, or access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information during registration.
3. Bidding & Purchases
All bids are legally binding offers to purchase. Once a bid is placed, it cannot be retracted except in exceptional circumstances as determined by Provenance. The highest bidder at the close of an auction is obligated to complete the purchase. Buyer Protection fees apply to all purchases.
4. Payments
Payment must be completed within 5 business days of winning an auction. We accept major credit cards, bank transfers, and other approved payment methods. All payments are processed through secure, PCI-compliant payment providers. Funds are held in escrow until delivery is confirmed.
5. Shipping & Delivery
Sellers are responsible for shipping items within 3 business days of receiving payment confirmation. All shipments must be fully insured and include tracking. Provenance is not liable for shipping delays caused by carriers or customs authorities.
6. Returns & Disputes
If an item is significantly not as described, buyers may initiate a return within 3 days of delivery. Our dispute resolution team will review the case and may arrange a return and refund. Items must be returned in the same condition as received.
7. Seller Commissions
Provenance charges sellers a commission on successfully sold items. The commission rate varies by category and is deducted from the final sale price before payment is disbursed to the seller. There are no upfront listing fees.

8. Buyer Commissions
Provenance charges buyers a buyer premium on the hammer price of every successful purchase. The premium varies by category and is shown separately at checkout, on top of the item price.

9. Limitation of Liability
Provenance acts as a marketplace and is not a party to transactions between buyers and sellers. While we verify items and sellers to the best of our ability, we do not guarantee the accuracy of all descriptions. Our maximum liability is limited to the Buyer Protection fee paid.
10. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance. We will notify registered users of material changes via email.
